Probate, #11292, (o.s.) 51:428, 519-20 (FHL #493874). James apparently died while in military service at Ft. William Henry, NY. This area was the scene of intense conflict during the French and Indian War at this time. James died unmarried, as David Fales, apparently his uncle, administered the estate. An abstract of the muster roll of Capt. Benjamin Johnson's Co. shows that James Fales was an ensign in the Crown Point Expedition, serving from 10 Sep-29 Nov 1755. He may have died on the latter date, but the roll does not indicate that he died in the service (Massachusetts Archives, 94:81, by corr, 10 Oct 1995).

NOTE: Samuel was probably married but the evidence is unclear as to his wife's identity. In a deed to William Learned, 1 Sep 1802, Samuel Foster of New Salem had a wife Selah (Franklin Deeds, 18:42 [FHL #893809]). However, a mar rec exists in New Salem for Samuel Foster, 2d, and Abigail Felton, 27 Jan 1796 (VITAL RECORDS OF NEW SALEM [Salem, MA, 1927], 73 [FHL #823686 item 5]). There were apparently two Samuel Fosters in New Salem, and it is not clear which Samuel married which wife.

In the same file the deposition by Eden Foster, Lemuel's eldest son, 26 Apr 1847, states that his father died on "25" Aug 1824 at Elba, NY (FHL #971008).

The Hammond Cemetery was probably more convenient to Joseph's home in Chaplin.
