The will of John Shatswell of Ipswich, 2 Feb 1646, proved 30 Mar 1647, refers to his sister Webster(THE PROBATE RECORDS OF ESSEX COUNTY, 3 vols. [Salem, MA, 1916-20],1:60-61 [FHL #974.45 P2p]). The mar date given in the printed Newbury vital recs is 29 Oct 1650, but John and Mary had children born as early as 1648. It is believed by some that this mar entry belongs to John Emery, Jr, whose wife was also named Mary. However, the town copy declares that the wife was the widow of John Webster, making her too old to be the mother of the children of John Emery, Jr. The original mar entry does not include the year, but it is found between entries dated 1648 and 1651. The year 1650 was added to the town copy by Newbury town clerk Henry Short about 1690, and it is believed that he erred in his estimation. 1647 is the most likely year for this mar. There is much confusion concerning this marriage. Some believe the mar of John Emery, Sr, John's father, to widow Mary Webster belongs to the son John. MAR: No mar rec found. Anthony's wife Frances sued him in York Co. Maine Court, 11 Oct 1660 for selling land without her consent (PROVINCE AND COURT RECORDS OF MAINE, 6 vols. [Portland, ME, 1928-75], 2:366 [FHL #974.1 N2m]). Perhaps the couple was now divorced. She may be a 2nd wife.
DEATH: No death rec found. Anthony was living in Portsmouth, RI as late as 9 Mar 1680/1 when he deeded his house and lands to dau Rebecca Sadler (Portsmouth Land Evidences, 1:178 [FHL #945375]). Anthony probably died soon afterward. He is called "late of Portsmouth, deceased," in a deed from James Emery to Rebecca Eaton alias Sadler, 10 May 1700 (Ibid, 1:96).

MAR: No mar rec found. Three documents suggest John Bailey's wife Eleanor is the dau of John Emery. The will of John Emery, which does not identify all his children by name, makes Joseph Bailey overseer in the event that his son John Emery or son-in-law Abram Merrill die before the provisions of the will are carried out. Joseph Bailey is the son of John and Eleanor Bailey. The will of John Bailey, Sr, of Newbury, 28 Oct 1651, proved 13 Apr 1652, calls John Emery, Sr, "brother" (THE PROBATE RECORDS OF ESSEX COUNTY, 3 vols. [Salem, MA, 1916-20], 1:145-46 [FHL #974.45 P2p]). John Bailey, Sr, is the father of John Bailey whose wife was Eleanor. The term brother was sometimes applied to men whose children married. The estate of Isaac Brown of Newbury was administered by his widow, Rebecca, who is the dau of John and Eleanor Bailey. In an agreement concerning the disposal of the estate, 29 Sep 1674, Rebecca desired that her "brother" (brother-in-law) Francis Brown and uncle John Emery be overseers of the agreement (PROBATE RECORDS, 2:398). The suggestion is that John Emery is a brother of Rebecca's mother, Eleanor. Finally, Samuel Sewall wrote in his diary on 21 May 1704: "The aged [James] Ordway comes to see me, complains bitterly of his cousin John Emery's carriage to his wife, which makes her leave him and go to her sister Bayly." ("Diary of Samuel Sewall, 1674-1729," COLLECTIONS OF THE MASSACHUSETTS HISTORICAL SOCIETY, 5th series, 6[1879]:102 [FHL #1011923]). Hence, James Ordway's wife, Anne Emery, had a sister who married a Bailey.
